Courageous Endeavors, LLC. is a controller, a legal entity responsible for personal data that you exchange with us, as well as a processor of your personal data.

  1. What personal data do we collect from you?

“Personal data” that we collect from you relates to your personal information that can be used to identify you as an individual, such as:

For Clients:

  • your name, company, email address, phone number, billing address, and shipping address;
  • your Courageous Endeavors, LLC. username and password;
  • credit card information;
  • any account-preference information you provide us;
  • your computer’s domain name and IP address, indicating where your computer is located on the session data for your login session, so that our computer can “talk” to yours while you are logged in.

For Consumers:

  • your name, email address, and phone number;
  • your origin and destination home addresses, if provided;
  •  your computer’s domain name and IP address, indicating where your computer is located on the Internet;
  • credit card information, if applicable;
  • video and still images of you and your household goods items.
  1. Why do we collect your personal data?

Courageous Endeavors, LLC.  collects, uses, and discloses personal data relating to customers and clients for the purposes of developing and managing processes and technologies for recording video surveys of household goods, preparing household goods’ inventories, communicating pricing and other useful information between people who need to move and moving industry service providers and facilitating the ‘booking’ of various services by such people with such service providers. If you provide personal data to us, either directly or through a reseller or other business partner, we will use or disclose your personal data for the following purposes:

  •        as necessary to provide survey and cubing services;
  •        as necessary to provide moving quotes and facilitate moving services from third parties (for example, for this purpose we may disclose your personal data to moving service provider (such as moving and truck companies, and companies that provide moving materials));
  •        as necessary to provide products you have ordered, such as providing it to a carrier to deliver products and services you have ordered (for example, for this purpose we may disclose your personal data to moving service provider (such as moving and truck companies, and companies that provide moving materials) and lifestyle partners (such as temporary housing));
  •         as necessary for tax withholding and payroll reporting, if you received a lump sum payment for your move from your employer (for example, for this purpose we may disclose your personal data to a third party that would perform the above mentioned financial services);
  •         use your contact information to provide you with information we believe you need to know or may find useful, such as news about our services and products and modifications to the Terms & Conditions;
  •         use it in the aggregate with other information in such a way so that your identity cannot reasonably be determined (for example, for statistical compilations);
  •         for technical administration of our website(s); research and development; customer and account administration.
  • as required by law, for example, in response to a subpoena or search warrant;
  • to outside auditors who have agreed to keep the information confidential;
  • as necessary to enforce the Terms & Conditions;
  • as necessary to protect the rights, safety, or property of Courageous Endeavors, LLC., its users, or others; this may include exchanging information with other organizations for fraud protection and/or risk reduction;
  • use your personal data in other ways described in this privacy policy, or to which you have otherwise consented.

We may provide your personal data only to contracted third parties for surveying and execution of your move. Courageous Endeavors, LLC. has responsibility for the processing of personal information it receives under the Privacy Shield and subsequently transfers to a third party acting as an agent on its behalf. Courageous Endeavors, LLC. shall remain liable under the Privacy Shield Principles if its agent processes such personal information in a manner inconsistent with the Principles, unless Courageous Endeavors, LLC. proves that it is not responsible for the event giving rise to the damage.

      Depending on the purpose of use of your personal data, there can be following legal basis for processing of your personal data:

Courageous Endeavors, LLC.’s legitimate interest, such as improvement of our products and services, and prevention of fraud; Performance of our duties from the agreement concluded with you; Based on law.

  1. How long do we keep your personal data?

Your personal data can be processed for specified and legitimate purposes only, as stated in section III of this Privacy Policy, and Courageous Endeavors, LLC. may retain it for the duration of the completion of such purposes. If there is a need to comply with legal requirements, we will be obliged to keep your personal data beyond the expiration of designated purposes.

As explained in section VI of this Privacy Policy, persons to whom personal data pertain may request deletion of some of their data at any time. Not all data can be immediately deleted pursuant to such a request, because its retention may be necessary for the provision of contracted services or the preservation of business relationships.

Some data we delete automatically after a specific period of time, while some are converted and preserved in anonymized form. When you request erasure of your data, we follow a strict deletion policy to make sure that your data is safely and completely removed from our servers, or retained only in anonymized form. We may need anonymized data for different business intelligence matters, such as analytics and statistical purposes, as mentioned in section III.

  1. Where do we store the data?

All data on our web site and services, including your personal data, is stored on Amazon Web Services and Microsoft’s Azure servers, which are located in the United States. Therefore, if you reside outside of the U.S. and use our website, and wish to be provided with Courageous Endeavors, LLC. services, your personal data will be transferred outside of your home country.

Since the United States has not received a finding of “adequacy” from the European Union under Article 45 of the General Data Protection Regulation (“GDPR”), Courageous Endeavors, LLC. relies on derogations for specific transfer situations, as set forth in Article 49 of the GDPR. In particular, Courageous Endeavors, LLC. collects and transfers to the U.S. personal data only: with your consent; to perform a contract with you; or to fulfill Courageous Endeavors, LLC.’s compelling legitimate interest in a manner that does not outweigh your rights and freedoms. 

Courageous Endeavors, LLC. also enters into data processing agreements and model clauses with its partners whenever feasible and appropriate.

The Article 29 Working Party has:

approved the AWS Data Processing Agreement which includes the Model Clauses, and

found that the AWS Data Processing Agreement meets the requirements of the GDPR Directive with respect to Model Clauses.

Having signed the Data Processing Addendum, we (Courageous Endeavors, LLC.) are also a part of the agreement with E.U.Model Contract Clauses.

Under GDPR, you have a right to be informed about what personal data Courageous Endeavors, LLC. collects about you and how it is used. That is what this Privacy Policy primarily serves for. We may have to charge you some reasonable administrative fees related to the provision of your personal data. In addition, when technically feasible and upon your request, Courageous Endeavors, LLC.  will transmit your personal data directly to another controller.   

You may also request information about who else outside Courageous Endeavors, LLC.  might have received the data. You have a right to correct (rectify) the record of your personal data maintained by Courageous Endeavors, LLC., if it is inaccurate. You may request that Courageous Endeavors, LLC. erases that data or ceases processing it, subject to certain exceptions. You may also request that Courageous Endeavors, LLC. ceases using your personal data for direct marketing purposes. In many countries, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how Courageous Endeavors, LLC. processes your personal data.

In addition, Courageous Endeavors, LLC. complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, respectively. Courageous Endeavors, LLC. has certified to the Department of Commerce that it adheres to the Privacy Shield Principles, and such certification also covers its 100% owned subsidiary Move Genius, LLC. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. If we transfer personal information received under the Privacy Shield to a third party, the third party’s access, use, and disclosure of the personal data must also be in compliance with our Privacy Shield obligations. 

Federal Trade Commission Jurisdiction

The Federal Trade Commission (FTC) has jurisdiction over Courageous Endeavors, LLC.’s compliance with the Privacy Shield. We may be required to disclose personal information that we handle under the Privacy Shield in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
